Seamless’ Live the Dream Competition

Terms and conditions for Seamless Recordings’ Live the Dream DJ mix competition.

1. These terms and conditions (“Terms”) set out your rights and obligations and those of by Meerkat Music Limited (“MML”) the owner of Seamless Recordings. MML is also referred to in these Terms as “we”, “us” and “our”.

2. By entering the competition you agree to comply with and be bound by these Terms. Entries that do not comply with the terms and conditions will be deemed invalid.

3. Unless otherwise specified, competitions are open to everyone aged 18 or over anywhere in the world except employees of MML or Beatport, their immediate families, agents or anyone professionally connected to the relevant competition.

4. To register for the competition, you must download at least one version of the track ‘The Making of You’ by Soneec, Lauer and Canard feat. Robert Owens (“the Track”) from Beatport www.beatport.com. The Track will be available from 28th May 2010.  The price of the Track will vary from region to region and to enter you only need to download & include one mix of the Track. NOTE: You do not need to download the WAV files to enter but at least 1 (one) mix of the Track must be downloaded from Beatport.com in order to qualify for the remix contest. Remixes created using illegally obtained mixes of ‘The Making of You’ will be disqualified from the contest.

5. To enter, create a DJ mix performed by you (“Mix”) no less than twenty minutes and nor more than thirty minutes in length which Your Mix must include at least one version of the Track downloaded from Beatport by you. Mixes will be judged on creative track selection and your mixing skills and ability. 

6. To submit your Mix upload it to the Seamless Live the Dream SoundCloud DropBox http://soundcloud.com/seamless-live-the-dream at any time between 28 May 2010 and 2 August 2010 Entries must be MP3 continuous mixes 192kbps.  Your DJ mix file name must include your professional DJ name.

7. To complete your entry, when you have submitted your Mix, email graham@seamlessrecordings.com with your Mix file name, and the full track listing for the Mix together with your name, date of birth, home address and contact telephone number, professional DJ name and short biography.

8. Entries will be judged by a panel of DJs selected by MML and Beatport. There will be one winner and the winner will be announced and contacted on 10 August 2010.  To be eligible for the prize the winner must be able to comply with these Terms.

9. Your mix must be your own mix and must not contain anything which is an infringement of copyright or any related rights (for the avoidance of doubt it must not contain any illegally downloaded music or uncleared samples) or anything which could bring the MML or Beatport into disrepute or which is defamatory, obsence or would constitute a contempt of court.

10. Entrants will retain copyright in their Mixes but by entering the Competition entrants grant to MML a worldwide royalty-free perpetual licence to edit, publish and use each Mix in any and all media (including print and online) for publicity and promotional purposes and to use their names (and photos if submitted) and professional DJ names for publicity purposes in any and all media.

11. MML will not be liable for any failure of receipt of Mixes. MML takes no responsibility for any entries that are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid. Entries will not be acknowledged or returned.

12. All rights in MML’s trademarks and logos are reserved to MML

13. The prize is one return flight to Ibiza with two nights’ accommodation at Es Vive Hotel, and the chance to perform a DJ set at the Seamless Recordings/Beatport Beach Party on 8 September 2010 (the “Event”). MML will also offer the winner the chance to record a full length DJ mix for release on Seamless Recordings exclusively through Beatport using Seamless Recordings (subject to signed contract).,

14. The winner must be able to travel to the Event on 7 September 2010 and be able to perform a live DJ set for a minimum of 60 minutes at the Event on the 8 September 2010.

15. The winner must have a valid passport and is responsible for obtaining any visas necessary for travel, for their own travel insurance and subsistence costs (food and so on).

16. Winners must notify MML in writing in advance of any criminal record or anything that could bring MML or its partners into disrepute.

17. The winner will not be compensated if they miss their scheduled flight to Ibiza as notified by MML to the winner but if they are unable to fly to Ibiza and attend the Event due to a force majeure event (e.g. volcanic ash) MML agrees to pay the winner a cash prize alternative of £200 (two hundred pounds sterling).

18. The winner is responsible for their own travel costs to and from the airport at origin but will have transport provided for them on Ibiza to and from the airport to the Hotel and to the Event.

19. Any breach of these Terms by an entrant will void their entry. Misrepresentation or fraudulent entries will invalidate an entry. MML’s decision is final and no correspondence will be entered into.

20. You agree to indemnify, defend and hold us and Beatport, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liabilities, damages, losses, costs and expenses, including legal fees, arising out of any breach of the Terms by you.

21. For a list of winners please send a stamped envelope to Competitions, Meerkat Music Limited, 26 Abbeville Mews, 88 Clapham Park Road, London SW4 7BX stating for which competition you would like winner’s details.

22. We shall not be liable in contract, tort, negligence, or otherwise, for any loss or damage whatsoever arising from or in any way connected with your entry to the competition or claiming of prizes, whether direct or indirect, including, without limitation, damage for loss of business, loss of profits, loss of reputation, business interruption, loss of business information, or any other pecuniary or consequential loss (even where we have been notified by you in advance of the possibility of such loss or damage). Neither MML nor Beatport accept any responsibility for any damage, loss, liability, injury or upset caused to or suffered by you as a result of entering the competition or winning the prize. MML and Beatport accept no liability for any damage caused to any person’s computer or other electronic device relating to or resulting from downloading any materials, including so called computer viruses, in connection with this competition. Nothing shall exclude us from our liability for death or personal injury as a result of our negligence.

Nothing in these Terms shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees, or any other liability which may not by law be excluded.

23. We may revise these Terms (and/or cancel, modify or supersede the competition (including altering prizes) if in our discretion the competition is not capable of being conducted as specified) at any time by posting changes online and you agree to be legally bound by these terms as updated and/or amended.

24. The invalidity or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision. Any such invalid provision shall be deemed to be severable, and the remainder of these Terms shall remain valid and enforceable.

25. No waiver by us of any of these Terms shall be construed as a waiver of any preceding or succeeding breach of any of these Terms.

26. These Terms and your Mix shall be governed by and construed in accordance with the laws of England and Wales and any dispute hereunder shall be subject to the exclusive jurisdiction of the competent English courts.
